Delaware law offices in Census data
County Business Patterns (CBP) 2023 counts offices of lawyers (NAICS 541110) statewide.
| Measure (2023) | Delaware |
|---|---|
| Establishments | 430 |
| Employees (week of March 12) | 4,914 |
| Annual payroll | $834,310,000 |
| Average employees per establishment | 11.4 |
| Average annual pay | $169,782 |
| Share of US law offices | 0.26% of 165,491 |
| Rank among the states by establishments | 47th |
The headline numbers point the same way: few offices, but large and well paid. The US averages, from the same dataset, are 6.6 employees per office and about $125,600 in pay.
Three counties, two markets
Our tabulation of the Census Bureau's 2023 county file splits the state like this:
| County | Offices | Employees | Average annual pay |
|---|---|---|---|
| New Castle County | 341 | 4,207 | about $184,200 |
| Sussex County | 52 | 352 | about $89,600 |
| Kent County | 36 | 354 | about $78,400 |
New Castle County, with Wilmington, has 79% of the offices, 86% of the jobs and almost all the large offices. Kent County, with Dover, and Sussex County, along the beaches, are small-practice markets whose pay looks like Rochester's or El Paso's, not Wilmington's. One office isn't assigned to a county in the file.
| Employees per office | Offices (statewide) |
|---|---|
| 1 to 4 | 230 |
| 5 to 9 | 85 |
| 10 to 19 | 61 |
| 20 to 49 | 39 |
| 50 to 99 | 8 |
| 100 to 249 | 5 |
| 250 or more | Not published |
Grouped, 376 offices have 1 to 19 employees, 47 have 20 to 99 and seven have 100 or more. The seven is the total less the smaller classes, so two offices sit in classes of 250 or more that the Census Bureau doesn't publish, to protect confidentiality. All five offices of 100 to 249 are in New Castle County.
The count's limits: it counts offices with paid employees, not firms, so a firm with Wilmington and Georgetown offices counts twice. Lawyers practicing alone without staff are excluded; the Census Bureau's Nonemployer Statistics count 590 legal services businesses with no paid employees in Delaware in 2024, 491 of them sole proprietorships. In-house and government lawyers are counted in their employers' industries. No Delaware law firm is an SEC-registered public company.
Why Delaware's firms look different
The likeliest explanation is the state's corporate franchise. The Delaware Division of Corporations reports 2,287,728 business entities in Delaware in 2025 and 334,461 new entities formed that year, more than 15% above 2024. Over two-thirds of the Fortune 500 are incorporated in Delaware, and nearly 70% of US-based IPOs in 2025 chose it. Companies formed under Delaware law need advice on that law, for governance, deals and disputes, and the large Wilmington offices are where that work is done, often for clients based in other states. It's no accident that the search results for this query are dominated by Wilmington corporate and commercial litigation firms, or that New Castle County pays like a big-city market.
Finding and checking a Delaware lawyer
| Need | Where to start |
|---|---|
| A lawyer for a personal or local matter | The Delaware State Bar Association's online Lawyer Referral Service, which sorts requests into 17 practice areas |
| A directory of Delaware lawyers and firms | The DSBA's Delaware Legal Directory: over 3,200 Delaware attorneys and judges, firms with their partners and associates, and in-house counsel. The online version is for members; the print edition has been $99 for non-members, though the 2026 edition was delayed by a technical issue |
| A record of public discipline | The Office of Disciplinary Counsel's digest of lawyer discipline |
| A sense of how admission works | The Board of Bar Examiners: graduation from an ABA-accredited law school, the Delaware Bar Examination, a character and fitness review and a 12-week clerkship, under Supreme Court Rules 51 to 56 |
The clerkship rule is unusual: every newly admitted Delaware lawyer has spent 12 weeks clerking, which ties new lawyers to the existing bar from the start. For a corporate matter, ask how much of the firm's Delaware work is the kind you need, who in the Wilmington office will handle it and how it bills.
Prospecting Delaware law firms
There are two very different targets. The corporate bar in New Castle County, 341 offices including every large one, buys like large firms elsewhere: administrators, IT and finance leads evaluate, a management committee approves, and security review is standard. Kent and Sussex counties' 88 offices are small practices where the owning lawyer decides. Selling to law firms covers both patterns; for the businesses behind the corporate work, the Delaware Prosperity Partnership publishes a major employers list and economic data.
Illustrative example. The company, prices and results are invented.
Brandywine Lateral (brandywine.example) recruits corporate and litigation associates for Wilmington firms. It targets New Castle County offices of 20 or more employees: 32 + 6 + 5 = 43 from the county file, plus the two statewide offices of 250 or more, so about 45. Two contacts each (the hiring partner and the recruiting or HR manager) is 90 people. At an 8% reply rate, seven conversations; if two firms give it a search and one placement closes at a 20% fee on a $200,000 salary, that's $40,000. With 45 accounts, the research is the job: which practice groups are hiring, who just left, which matters are growing.
Subject: Corporate associates for [firm]'s Wilmington office Hi [first name], I noticed [firm] has posted for a [year]-class corporate associate in Wilmington, and [a recent move or matter]. Most of the candidates who fit that profile aren't on job boards; they're at peer firms and not looking. I place associates with Delaware corporate experience and can share three anonymized profiles this week. Would that be useful? [Your name]

Questions people ask
How many law firms are in Delaware?
Census County Business Patterns counted 430 law offices with paid employees in Delaware in 2023, employing 4,914 people, which ranks the state 47th by office count. New Castle County had 341 of them. Another 590 legal services businesses had no paid employees in 2024. The Delaware State Bar Association's directory covers over 3,200 Delaware attorneys and judges.
Why are so many companies incorporated in Delaware?
The Delaware Division of Corporations reports that over two-thirds of the Fortune 500 are incorporated in Delaware and that nearly 70% of US-based IPOs in 2025 chose the state. It counted 2,287,728 business entities in 2025. That corporate franchise is why Delaware's law offices are larger and better paid than the national average, especially in New Castle County.
How do I find a lawyer in Delaware?
For a personal or local matter, start with the Delaware State Bar Association's online Lawyer Referral Service, which sorts requests by practice area. The DSBA also publishes the Delaware Legal Directory of attorneys and firms. Before hiring, check for public discipline in the Office of Disciplinary Counsel's digest, and ask who will handle your matter and how it will be billed.
What does it take to become a Delaware lawyer?
The Delaware Board of Bar Examiners lists four requirements: graduating from an ABA-accredited law school, passing the written Delaware Bar Examination, completing a character and fitness evaluation and completing a 12-week clerkship. Admission is governed by Delaware Supreme Court Rules 51 to 56 and the Board's own rules. The clerkship is a requirement most states don't have.
How much do Delaware law firm employees earn?
Average annual pay at Delaware law offices was $169,782 in 2023, from Census County Business Patterns, against about $125,600 nationally. In New Castle County it was about $184,200, and in Kent and Sussex counties under $90,000 (our calculation from the Census county file). The figures cover all employees, from staff to associates, and exclude partners who own their firms.
