Staffing agencies in Birmingham, AL: a market of big temp branches and how to deal with one

Birmingham's 172 staffing offices are big ones: the average location carries 67 people on its payroll, almost all of them temps. With Alabama setting no wage floor of its own, the contract you sign does most of the protecting.

The Birmingham staffing market in numbers

Source: US Census Bureau, County Business Patterns 2023, for the Birmingham, AL Metro Area (CBSA 13820). Two industry codes are counted: NAICS 56131 (Employment Placement Agencies and Executive Search Services) and NAICS 56132 (Temporary Help Services).

The industry rows are from the Census Bureau's 2023 metro file. Temp help is 97% of the market by headcount. That isn't because Birmingham agencies have large office teams: temp agencies are the employer of record for the workers they place, and the Census definition says those workers "are employees of the temporary help services establishment." A machine operator placed at a plant in Bessemer counts as staffing employment, not manufacturing. Placement and search firms, whose candidates go on the client's payroll, are a sliver of the market.

The Census Bureau doesn't publish the larger classes for the two codes combined, but it does for temp help alone, and those classes add up to all 145 temp locations. Subtracting the published cells from the total leaves 64 locations with 50 or more employees: 62 temp help branches and two placement or search offices whose class isn't published. More than a third of Birmingham's staffing locations have 50 or more people on payroll.

Shelby County's employee total was published but flagged as high-noise: the noise the Census Bureau adds for confidentiality changed it by 5% or more. Jefferson County has 68% of the locations and 70% of the employees. St. Clair County's six locations average about 83 employees each, the biggest of the three.

Limits. These are establishments with paid employees, not companies: a regional chain with six Birmingham branches counts six times, and recruiters working alone without payroll are excluded. Professional employer organizations (NAICS 561330) are counted separately and left out here, though they matter in Birmingham: 8 PEO locations reported 2,197 employees, more than placement and search combined. Employment is a single week in March 2023.

What Alabama regulates, and what it doesn't

  • Wages. The US Department of Labor lists Alabama as having no state minimum wage law, so employers covered by the Fair Labor Standards Act pay the federal $7.25. The federal act also requires overtime at not less than one and a half times the regular rate for hours over 40 in a workweek, and the agency, as employer, owes it.
  • Agencies. We found no Alabama licence or registry for staffing agencies or PEOs. There's no state list to check an agency against.
  • The business itself. The Alabama Secretary of State's business entity search lets you look up the legal entity by name, number or registered agent.

That makes your contract the main protection. Get these in it: the pay rate and the markup as separate numbers, how overtime and holidays are billed, the conversion fee if you hire a temp, who provides safety training and protective equipment, and certificates of workers' compensation and general liability insurance naming your company.

Kinds of agency in Birmingham

Light industrial and manufacturing temp is the core of this market, supplying production, warehouse and maintenance workers to plants and distribution centers. Around it you'll find office and clerical staffing, healthcare staffing for the region's hospitals and clinics, IT and engineering contract firms, a handful of direct hire and executive search offices, and PEOs that co-employ a client's existing staff. Temp-to-hire is common on the industrial side: you take a worker on the agency's payroll for a trial period, then hire them, sometimes for a conversion fee.

Worked example: how overtime gets billed

Illustrative example. The company and every rate are invented; the time-and-a-half rule is federal.

Red Mountain Castings (redmountain.example) runs 30 temps for a 12-week peak at 50 hours a week. The agency pays $16.00 an hour with a 38% markup, a $22.08 bill rate. Overtime pay is $24.00 an hour. The two common contract terms bill overtime differently:

Overtime billing termOvertime bill rate3,600 overtime hours
1.5 times the bill rate$33.12$119,232.00
Overtime pay plus the same $6.08 spread$30.08$108,288.00

The straight-time hours (14,400 at $22.08, or $317,952.00) cost the same either way. The overtime term alone is worth $10,944.00 over the peak, because the first version marks up the overtime premium as well as the base pay. Neither is wrong, but agree which one you're buying before the first long week.

Finding an agency or work through one

ClearlyRated lists 69 Birmingham staffing agencies with client and talent ratings, filterable by industry focus such as industrial, healthcare and IT. Its Best of Staffing award requires a Net Promoter score of at least 50%. Job seekers should register with the agencies that place people in their trade, ask whether the assignment is temp or temp-to-hire, and check the first pay stub against the agreed rate, including overtime. Selling to Birmingham staffing agencies

Because the market is concentrated in big temp branches, the volume buyers are easy to name by type, if not by name: the 62 temp locations with 50 or more employees. They buy drug and background screening, occupational health, safety training and protective equipment, timekeeping and payroll, workers' compensation insurance, and recruiting ads for production roles. The branch manager feels the problem; regional operations or the owner signs, and national brands buy many of these centrally.

The small end, 80 locations with fewer than 20 employees, is mostly owner-run temp offices plus the 27 placement and search firms. They buy job boards, applicant tracking and candidate data, and the owner decides.

Start with the ClearlyRated listings and the Birmingham Business Alliance member directory, confirm each firm on the Secretary of State's entity search, then sort by the roles each one advertises. Branches posting dozens of production and forklift roles are the screening and safety prospects. Doing that by hand for dozens of branches takes days; Bebop finds the matching agencies, researches each one and drafts the outreach. For the plants and warehouses behind the demand, see manufacturing companies.

Questions people ask

How many staffing agencies are in Birmingham, AL?

Census County Business Patterns counted 172 staffing agency establishments in the Birmingham metro area in 2023, employing 11,547 people: 145 temporary help locations, 19 employment placement agencies and 8 executive search offices, with 117 in Jefferson County. Counts are of locations with paid employees, so a chain counts once per branch and recruiters without payroll aren't included.

Do staffing agencies need a license in Alabama?

We found no Alabama licence or registry for staffing agencies or professional employer organizations, so there's no state list to check one against. Verify the legal entity on the Alabama Secretary of State's business entity search, ask for certificates of workers' compensation and general liability insurance naming your company, and put pay rate, markup, overtime billing and conversion fees in the contract.

What is the minimum wage for temp workers in Alabama?

Alabama has no state minimum wage law, according to the US Department of Labor, so employers covered by the federal Fair Labor Standards Act, including staffing agencies, must pay at least $7.25 an hour. The same federal law requires overtime of at least one and a half times the regular rate for hours over 40 in a workweek. Market pay for most temp jobs in Birmingham is above the minimum.

How do staffing agencies bill overtime?

Usually one of two ways: at one and a half times the regular bill rate, which marks up the overtime premium too, or at the overtime pay rate plus the agency's normal dollar spread. In an illustrative Birmingham example with a $16.00 pay rate and 38% markup, the first method bills $33.12 an hour and the second $30.08, a $10,944 difference over 3,600 overtime hours.

Why are Birmingham staffing agencies so large?

Census data for 2023 show Birmingham's staffing locations averaging 67.1 employees, against 44.2 in the Atlanta metro and 49.5 in Charlotte's. Temp agencies employ the workers they place, and Birmingham's market is mostly temp help branches: 62 of its 145 temp locations had 50 or more employees, while placement and search firms, which stay small, number only 27.
