Staffing agencies in Virginia: 1,182 locations, three very different regions and the rules to check

Virginia's staffing industry is really three markets: Northern Virginia, where temp help pays about $92,000 a year in Fairfax County; Richmond; and Hampton Roads, where it pays about a third of that. Add a block of large payroll offices with no fixed county, and the statewide totals need reading with care.

Virginia had 1,182 staffing agency establishments in 2023, employing 72,265 people on a $4.11 billion payroll (Census County Business Patterns), 15th among the states: 906 temp help locations, 149 placement agencies and 127 executive search offices. Fairfax County had the most, 260. To choose an agency, match it to the role, check its workers' compensation coverage, confirm any PEO's registration with the Virginia Workers' Compensation Commission, and be clear whether you'd be a W-2 employee or a contractor.

  • 1,182 staffing establishments in Virginia employ 72,265 people; temp help locations hold 65,068 of them.
  • Temp help pays an average of about $92,300 in Fairfax County and about $31,100 in Virginia Beach.
  • 65 temp help establishments with no fixed county carry 24,995 employees, including all nine of the state's 1,000-plus temp establishments.
  • Virginia law presumes a paid worker is an employee in a misclassification suit unless IRS guidelines show otherwise.
  • In the worked example, three sales territories split the state at 430, 431 and 264 locations.

Virginia staffing agencies in Census data

Reading the employee count

A temp agency employs the people it places, so its temps at client sites are counted at the agency. That alone makes temp help 90% of the jobs. A second effect is geographic: Census says employment services firms that pay many workers from one payroll office may be published in a "statewide" category. Virginia's county file has 65 temp help establishments with no fixed county, employing 24,995 people, about 385 each. They include 7 establishments with 500 to 999 employees and 9 with 1,000 or more, every one of the state's 1,000-plus temp establishments. Their workers are spread across counties, so county figures understate where temps actually work.

Professional employer organizations are a separate industry with 76 locations and 13,592 employees.

In broader bands, 700 establishments have 1 to 19 employees, 310 have 20 to 99 and 172 have 100 or more; the 172 is the total less the smaller bands, because the Census Bureau doesn't publish the two top classes for the combined codes. The temp help row has 11 establishments with 500 to 999 employees and 9 with 1,000 or more; two placement locations sit in the unpublished classes. All counts are establishments with paid employees, not companies, and exclude self-employed recruiters.

Three Virginias: temp help by place

Place (county file, temp help)EstablishmentsEmployeesAverage annual pay
Fairfax County1788,502about $92,300

Henrico County763,672about $74,300

Norfolk city281,887about $33,400
Virginia Beach city493,028about $31,100
Statewide, no fixed county6524,995about $57,400

The same industry code covers very different work. A Fairfax County temp help payroll averaging about $92,300 a head suggests professional contracting; Virginia Beach and Norfolk, at about $31,000 to $33,000, suggest hourly assignments, some of them part year. Treat these as signals, not job data: County Business Patterns doesn't classify temps by occupation.

Virginia rules to check

RuleWhat it saysWhat to do
PEO registration (Code 65.2-803.1)A business must register with the Virginia Workers' Compensation Commission before providing professional employer services, and report new and terminated clients within 30 daysAsk a PEO for its registration and confirm your company is on its client list
Workers' compensationThe Commission says an employer regularly employing more than two employees must carry coverage, with no waiversGet the agency's certificate naming you
Misclassification (Code 40.1-28.7:7)A worker paid for services is presumed to be the payer's employee in a misclassification suit, unless shown to be an independent contractor under IRS guidelines; suits must start within three yearsAsk any agency paying contractors on a 1099 how it supports that status
Minimum wage (Code 40.1-28.10)$12.77 in 2026, $13.75 from 1 January 2027, $15.00 from 1 January 2028Price multi-year contracts in steps

Kinds of agency

  • IT and professional contract firms, placing developers, analysts, engineers and accountants by the hour.
  • Light industrial and commercial temp branches, for warehouse, manufacturing, call center and hospitality shifts.
  • Healthcare staffing, by shift or contract.
  • Direct hire placement and executive search, paid a fee per hire.
  • PEOs, which run payroll and benefits for your existing staff and must be registered.

How to vet a Virginia agency

  1. Check the entity with the State Corporation Commission.
  2. Ask for its workers' compensation certificate naming you, and for a PEO, its Commission registration.
  3. Ask how it pays its people: W-2 employees of the agency, or independent contractors.
  4. Get the pay rate, markup, overtime and conversion terms in writing.
  5. Call two references with similar roles in your region.

If you're looking for work

Agencies are paid by the employers they staff, so don't pay to register. If a staffing firm offers to pay you as an independent contractor, ask why: Virginia law presumes that someone paid for services is an employee in a misclassification suit, and gives a misclassified worker three years to bring one.

Worked example: splitting Virginia into sales territories

Illustrative example. The vendor and the three-rep plan are invented; the counts are from the County Business Patterns 2023 county file, both staffing codes.

A vendor selling to staffing firms has three reps for Virginia. The county file shows 1,125 staffing locations (it doesn't add exactly to the state file's 1,182).

Region (largest counties and cities)Locations
Northern Virginia: Fairfax County 260, Loudoun 65, Arlington 46, Alexandria 32, Prince William 12, Fairfax city 9, Manassas 6430
Richmond: Henrico 93, Chesterfield 58, Richmond city 56, Hanover 5212
Hampton Roads: Virginia Beach 62, Newport News 37, Norfolk 33, Chesapeake 27, Portsmouth 11, James City 9, Suffolk 8, Hampton 6193
Statewide payroll offices, no fixed county71
Rest of the state219

Rep one takes Northern Virginia (430). Rep two takes Richmond plus the rest of the state (431), a wide territory of small accounts best worked by phone. Rep three takes Hampton Roads plus the statewide payroll offices (264): fewer locations, but the statewide temp offices average about 385 employees each, so the accounts are among the largest in the state.

Questions people ask

How many staffing agencies are there in Virginia?

Census County Business Patterns counted 1,182 staffing agency establishments in Virginia in 2023, employing 72,265 people: 906 temp help locations, 149 employment placement agencies and 127 executive search offices. That ranked Virginia 15th among the states. Fairfax County had the most, 260, followed by Henrico County with 93. These are locations with paid employees, not companies.

Do staffing agencies need a license in Virginia?

Professional employer organizations must register with the Virginia Workers' Compensation Commission before providing services, under Virginia Code 65.2-803.1. For a temp or placement agency, check its registration with the State Corporation Commission and ask for its workers' compensation certificate; the Commission says employers regularly employing more than two employees must carry coverage.

Can a Virginia staffing agency pay me as a 1099 contractor?

It can try, but Virginia Code 40.1-28.7:7 presumes that someone paid for services is the payer's employee in a misclassification suit, unless the payer shows independent contractor status under IRS guidelines. A misclassified worker can sue the employer for the remedies available under Virginia wage law, within three years. Ask the agency to explain the basis for contractor status in writing.

Why does temp pay vary so much across Virginia?

Because the work differs. In 2023, temp help establishments in Fairfax County paid an average of about $92,300 a year, against about $41,800 in Chesterfield County and $31,100 in Virginia Beach, according to County Business Patterns. The Northern Virginia figure points to professional contracting; the Hampton Roads figures to hourly assignments, though the data doesn't classify temps by occupation.
